Conditions of use of Sobflous.tn

General Information

The provision of services throughout the sobflous.tn site is subject to your acceptance of the agreement. By completing the registration form, checking the box "I have read and agreed to the general terms of use of SOBFLOUS" and/or using the site, you submit to the terms and conditions below, legal data, and any other term and condition added to this agreement.

The terms "you", "your", or "yours" refer to the person or persons accessing this Site. Unless otherwise indicated, the terms "Sobflous", "we", "our", and "ours" refer to the company Hamtel Distribution.


The owner

The company Hamtel Distribution, is the owner and manager of the website www.sobflous.tn.


Membership Information

When you log in as a member of the sobflous.tn site, you must provide accurate, complete, and up-to-date information as requested in the registration form. You affirm that the information collected when filling out the registration form is true, accurate, and complete. It is your duty to inform us of any changes to this information, including your address. You can update this information at your convenience by accessing the "My Account" menu. All personal data you provide us as a subscribing member will be processed in accordance with the privacy policy of sobflous.tn. If you are under 18, you must obtain permission from your parents/guardians to use this site.


Account Closure and Data Deletion

If at any time you wish to close your Sobflous account and delete all your data, you can request closure through the form at the following link contact us.

One of our advisors will contact you by phone, and once the account closure request is validated by our administrators, you will no longer be able to use or reopen it, but you can register again to open another account.


Username and Password

Once you become a subscribing member of our site, you are fully responsible for any fraudulent use of your username and password, including unauthorized use of your credit card (or any other card). If you become aware that unknown users are using your username and password, notify us as soon as possible. If you forget or lose your password, you must request a new password by accessing the "forgot password" section on the login page. You also agree that you can only register in your own name. Each username and password must be used by only one person.


Intellectual Property

Intellectual property rights in all figures, information, systems, processes, or other materials used or developed by us for the purpose of providing the services or their performance obligations under the contract shall (or upon their creation) remain in our possession. You should use such material to receive the services as envisaged by this contract. Unless otherwise specified, intellectual property rights and content throughout the sobflous.tn site are owned by us or are licensed. Reproducing any part or all of the website in any way is strictly prohibited without our prior consent. However, you are permitted to print or download a copy of the website for personal and non-commercial use.


Payments
Monétique Tunisie Company:

Hamtel Distribution has entrusted its credit card payment system to SMT (Monétique Tunisie Company), expert in secure monetary transactions in Tunisia and specialized in securing online payments. We guarantee the total confidentiality of your banking information, secured by the SSL protocol, which systematically controls the validity of access rights during your credit card payment and encrypts all exchanges to ensure confidentiality.



Use of bank cards:

When making payments on sobflous.tn, you must use your personal Bank cards

  • If we detect that you have made suspicious transactions, your payment cards and your sobflous account will be blocked, and the relevant bank and the SMT will be immediately notified.
Tunisian Post Office:

La société Hamtel Distribution has entrusted its e-DINAR card payment system to the Tunisian Post.

  • At the cardholder level:
    • An 8-digit Internet PIN of the card.
    • Encryption of card data with the electronic certificate (128 bits) of the merchant site.
  • At the merchant kit level:
    • Encryption of card data and transaction information is done with a 1024-bit electronic certificate,
    • Real-time routing of transaction information directly to the payment platform, without storage on the merchant site.
  • At the payment server level:
    • Merchant authentication through an electronic certificate.

Use of prepaid cards from La Poste:

When making payments on sobflous.tn, you must use your personal e-DINAR cards

  • If we detect that you have made suspicious transactions, your payment cards and your sobflous account will be blocked, and the Tunisian post will be immediately notified.
Bank Transfer:

With bank transfer, you can top up your Sobflous balance and carry out multiple purchase transactions without using a credit card or e-DINAR card. You can make the transfer from any branch of the banks listed on the bank transfer page of sobflous.tn.

  • The number and the date of the payment/transfer must be entered correctly when requesting an account recharge. Your request will be rejected if any of the mentioned parameters are missing or incorrect.

Mobile Recharge
Direct Transfer:

(In accordance with the articles decreed by the Finance Law of 2018, which stipulates the new amounts of the stamp duty for all telecommunications operators). An SMS will be sent to you by the operator to confirm the success of the recharge operation.

Recharge Error: If the system has rejected your mobile recharge request, you can check the error message from the operator in the history section. The causes are multiple:

Recharge Cards:

The price increase of the recharge card represents the fiscal stamp duty imposed by Tunisian law.

The card number will be displayed to you just after the payment and will be recorded in the recharge history section.


Sports Betting Vouchers and Transfers:

Hamtel Distribution Company is the authorized service provider for the distribution of vouchers and the acceptance of vouchers and withdrawal transfers from the sports betting platforms Bountou1x2.com, Promocote.com, and bet216.tn through the website www.sobflous.tn and the Sobflous Android and IOS mobile applications.

All verified users on sobflous.tn can, from the "Shop" section, make online purchases with their bank cards, e-Dinar cards from the post office, by bank transfer.

The sports betting vouchers available on Sobflous are only valid for the following partner sites: Bountou1x2.com, Promocote.com, and bet216.tn.


Rules for Using the "Sports Betting Vouchers" Service:

Any purchase or transfer of sports betting vouchers or third-party withdrawal transfers at sobflous.tn is regulated according to the terms and conditions described below:

  • Before purchasing a sports betting voucher on sobflous.tn and to deposit the voucher amount, you must first have an account on one of the above-mentioned sports betting sites corresponding to the requested voucher name.
  • After purchasing your voucher on sobflous.tn, you must use the sports betting voucher before its expiration date as indicated on the virtual ticket you received. Beyond this date, the code will no longer be valid, and you cannot use it on the sports betting site.
  • Sobflous.tn will not be held responsible if the sports betting voucher you purchased expires before its use.
  • Sobflous.tn will not be held responsible if the voucher you purchased has been used by another person on the sports betting platform after the purchase date and time on sobflous.tn.
  • Purchasing a voucher allows you to deposit money into your account and enjoy the services available on partner sports betting platforms.
  • If you encounter a problem with the sports betting voucher you purchased on sobflous.tn (invalid code, expired code, etc.), you must inform us by email no later than 48 hours after the purchase transaction date. Beyond this deadline, your request will not be processed.
  • You are free to mention the voucher price you want to purchase on Sobflous.tn while respecting the minimum and maximum voucher amounts to generate. Prices are in Tunisian Dinar and inclusive of all taxes.
  • To make a withdrawal transfer from the partner site to your Sobflous account, you must insert and verify the payment ID number of your sobflous account and the corresponding name and surname to the ID number you entered. Sobflous.tn will not be held responsible if the withdrawal transfer in question is made to another Sobflous account.
  • By depositing a sports betting voucher on our platform, your Sobflous account will be credited with the amount of this voucher without any additional commissions.
  • By making a withdrawal transfer from a partner sports betting site to your Sobflous account, the latter will be instantly credited with the transfer amount without any additional commissions.
  • Purchasing a sports betting voucher on sobflous.tn is without any additional commissions. The price of the voucher is equal to the voucher value.
  • You cannot deposit a sports betting voucher you purchased on sobflous.tn into your Sobflous account or the Sobflous account of a relative. For depositing on Sobflous, the withdrawal voucher must be generated from the partner sports betting platform.
  • All sports betting vouchers you purchase on sobflous.tn are intended for personal use, and it is strictly prohibited to resell them without prior agreement from Hamtel Distribution Company.
  • You must strictly adhere to the daily account recharge quota granted to you by sobflous.tn after your registration. In the event of any attempt to exceed the allocated quota, by any means (for example: opening multiple accounts), your account as well as all bank cards or e-Dinars used will be permanently blocked on sobflous.tn.

Bank Transfer Service:
Rules for using the "Bank Transfer" service:

Any request for a bank transfer to a Tunisian bank account due to a cancellation of a purchase or a refund request or other reasons from a third party at Sobflous, is governed by the general terms of sale described below:

  • Before requesting a bank transfer, your Sobflous account must be verified.
  • Before the validation of a bank transfer by the Sobflous administrator, your bank account must be justified on Sobflous.
  • Before validating your first transfer, you must send us the file of your bank identity or bank statement containing a clear and readable RIB.
  • The bank account must imperatively have the same name as your Sobflous account, otherwise your request will be rejected.
  • Sobflous.tn will not be held responsible if the bank account you have provided is incorrect or belongs to another person. Validated transfers are irrevocable and cannot be canceled.
  • You are free to mention the amount you wish to transfer to your bank account, while respecting the minimum and maximum amount mentioned.
  • The service of transferring to a bank account is subject to a fixed and variable commission. The total commission amount is displayed in Tunisian Dinar and includes all taxes.
  • Any validation of a bank transfer from your Sobflous account constitutes your explicit and unequivocal agreement of the transferred amount and the commissions related to the transfer service mentioned before the operation confirmation.
  • You can cancel the bank transfer request only and only if the administrator has not yet validated your request.
  • The processing of your bank transfer request may take a few days.
  • You can make a bank transfer if and only if your Sobflous balance is equal to or greater than the amount to pay: Amount to transfer with commissions.
  • If you have a bank transfer request in progress, you cannot send another bank transfer request.

Service for Transferring Money to a Sobflous Account:

Any request for transferring balance to a Sobflous account is governed by the general terms of sale described below:

  • Your Sobflous account must be verified to benefit from the service of transferring money to another Sobflous account.
  • Sobflous will not be held responsible if the email or ID of the recipient you have validated is incorrect. Validated balance transfer operations on your Sobflous account are irrevocable and cannot be canceled.
  • You are free to mention the amount you wish to transfer to the recipient's Sobflous account, while respecting the minimum and maximum amount mentioned.
  • It is mandatory to enter your password or PIN to validate the balance transfer operation on your Sobflous account.
  • If you receive money on your Sobflous account from an unknown Sobflous account, you must immediately contact our customer service to report the incident. Otherwise, Sobflous will consider that you have benefited from a transfer error and violated the terms of use of Sobflous.
  • Your Sobflous account will be immediately blocked (temporarily or permanently) if the person who sent you money by balance transfer has not respected the terms of use of our platform or has been declared fraudulent.
  • Any validation of a balance transfer from your Sobflous account constitutes your explicit and unequivocal agreement of the transferred amount and the commissions related to the service before the operation confirmation. Sobflous will not be held responsible if another person has used your Sobflous account to validate any operation of any service available on our platform.

Postflous Service:

Hamtel Distribution Company is the official partner of La Poste Tunisienne and authorized to provide postal services on its Sobflous platform.

Verified users on Sobflous can, from the "Postflous" section, pay online with their bank cards, e-Dinar cards from La Poste Tunisienne, via bank transfer, through one of the Sobflous resellers, or via other payment methods for various services related to La Poste Tunisienne.

Rules for Using the "Postflous" Service:

Any purchase or payment related to a third-party Postflous service at Sobflous is regulated according to the described general sales conditions:

  • Your Sobflous account must be verified to benefit from the Postflous service.
  • The eDinar card must be registered with the same ID number as your Sobflous account, otherwise, your service registration request will be rejected.
  • Sobflous will not be held responsible if the eDinar card you have registered is incorrect or belongs to someone else. Validated eDinar recharge operations on your Sobflous account are irreversible and cannot be canceled.
  • You are free to mention the amount you wish to transfer to your eDinar card while respecting the minimum and maximum amounts mentioned.
  • The registration and unregistration services for the Postflous service and the eDinar card balance inquiry are free of charge.
  • The service of recharging the eDinar card via Sobflous balance, bank card, or eDinar card is subject to a fixed and variable commission. The total commission amount is displayed in Tunisian Dinar and includes all taxes before any operation related to the Postflous service.
  • The bill payment service via Sobflous balance, bank card, or eDinar card is subject to a fixed and variable commission. The total commission amount is displayed in Tunisian Dinar and includes all taxes before any operation related to the Postflous service.
  • Any validation of a payment for any operation available in the Postflous service from your Sobflous account constitutes your express and unequivocal agreement to the amount paid and the commissions related to the Postflous service mentioned before confirming the operation. Sobflous will not be held responsible if another person uses your Sobflous account to validate an operation for any service available on our platform.

Merchant Payment Service:

The online payment service is a set of dematerialized operations available to Sobflous.tn users, allowing them to settle purchases made on an e-commerce website or at a physical merchant partner of Sobflous. This settlement is done securely via the Sobflous account.

Service Operation:

After validating your cart on the merchant website and choosing the payment method via Sobflous or choosing to pay the merchant using their "merchant code," you can validate the operation using the following two methods:

1st Method:

You will fill out a form by entering information such as your email, password, or your phone number associated with your Sobflous account. You will then be redirected to the payment validation form to choose the method with which you wish to pay: national or international bank card, e-DINAR card from La Poste Tunisienne, or via your Sobflous balance.

Each merchant payment transaction is identified by a "Order Code" and each merchant is identified by a "Merchant Code" that you can use when validating the payment by accessing your Sobflous account under the merchant payment section.

  • Once the payment is validated, you cannot cancel the transaction anymore.
  • The merchant payment is validated instantly, and the delivery process is activated immediately.
  • If you have lost the payment code, you can retrieve it from the "merchant payment" transaction history.
  • The order code (website) remains valid for only 30 minutes. Beyond this period, the user can no longer pay with this code and must place another order on the merchant website.
  • The payment code you use to pay physical merchants remains valid for 72 hours after its generation date and time after payment.

Payment Execution:

The amounts to be paid mentioned on the merchant website are indicated in Tunisian Dinar (DT) including all taxes and are valid at the time of consultation by the customer. The payment will be immediately taken into account by the system. In case of unavailability, you will be notified, and your payment will not be processed. You can resume the payment later.

  • Once the payment is validated, you cannot cancel the transaction anymore.

The Payment:

To make a payment, you will need to choose Sobflous as the payment method by clicking on the appropriate button or enter the merchant code of the physical store where you want to pay. Your payment via the Sobflous service is managed by Hamtel Distribution Company, which offers a completely secure payment service. You guarantee to Sobflous that you have any necessary authorizations to use the chosen payment method when validating your payment request. You declare that you are the legitimate holder of the Sobflous account used for online payment and that you accept all consequences thereof if not.

User Protection and Rights:

1- Delivery Time:

The seller or the merchant website must deliver the goods to you or perform the service on the date indicated during the order. If no date was set during the order, the delivery of the goods or the execution of the service must take place no later than 1 month after the order.

In case of non-compliance with the delivery period, you can send a claim to Sobflous customer service from your Sobflous account under the "Merchant Payment" section.


2- Refund Period:

If you return the goods to Sobflous partner merchant or cancel the service after canceling your order due to non-compliance with the delivery period or if the product you purchased from the merchant's website is defective after delivery:

  • It is unfit for the usual use expected of a similar good..
  • It does not correspond to the description given by the seller (for example, the color does not match the model presented).
  • It does not possess the qualities advertised by the seller (for example, a device advertised as particularly quiet that turns out to be noisy).
  • You must be reimbursed within a maximum period of 1 month. However, the merchant may delay the refund until the goods are recovered or until you provide proof of shipment of the goods.

    The merchant must refund you the full amount you have paid, including delivery charges.

    In case of non-compliance with the refund period, you can send a claim to Sobflous customer service from your Sobflous account under the "Merchant Payment" section.


    3- Bonus Right:

    Each user will have a Bonus on purchases made from Sobflous partner merchants. This is a percentage deducted from the purchase transaction amount and added to the user's Bonus balance:

  • The Bonus granted to the buyer is not fixed and depends on the merchant or service on Sobflous and will be displayed before each payment execution.
  • The Sobflous partner merchant may not grant Bonuses to buyers for some or all of the items or services offered in their shop.
  • User payment validation means acceptance of the price and Bonus related to the item or service offered by the merchant or by Sobflous.
  • Sobflous customer cannot use the Bonus and transfer it to the Sobflous balance unless the Bonus balance exceeds 10 Tunisian Dinars.
  • You can transfer your Bonus balance only to your Sobflous balance..
  • If the payment has been canceled or the customer has been refunded, the Bonus amount related to the canceled transaction will be deducted from the customer's Bonus balance.
  • If the Bonus balance is less than the Bonus amount related to the canceled transaction, the latter will be deducted from the total or partial amount of the canceled transaction before refunding the customer.

  • Account transactions

    According to legal conditions, you authorize us to debit your SOBFLOUS account, bank card, or edinar card through this site by the amount you requested only if your account has been activated using your password or any other authentication process required during each connection and you have performed one of the following operations:

    • Purchase of phone recharge by direct transfer or recharge card
    • Balance transfer to another SOBFLOUS account
    • Purchase of an online purchase coupon
    • Merchant Payment by Sobflous
    • Payment for one of the Postflous services: eDINAR recharge, bills, etc...
    • Bank transfer request

    Also knowing that all debits may result in your full responsibility

    Commission on Postflous service:Paid post fees (between 1 and 2 dt per transaction) and variable bank fees)

    Bank transfer fee: Charged 2 dt with variable bank fees of the requested amount.


    Errors and unauthorized transactions

    Identification of errors and/or unauthorized transactions. You can check the history of your transactions at any time by logging into your account on the Sobflous website and clicking on the "History" tab. It is very important that you inform Sobflous immediately if you have reason to believe that any of the following situations have occurred: (i) an unauthorized transaction has been made on your account; (ii) unauthorized access has occurred on your account; (iii) your password has been compromised; someone has transferred or may transfer money using your account without your authorization (collectively referred to as “Fraudulent account access”You must also inform us immediately if you have reason to believe that an error has occurred on your Account.

    In order to immediately inform Hamtel Distribution of any of the above events, you undertake to monitor your Sobflous Account carefully and regularly. We will not seek to hold you responsible for any unauthorized use of your account by anyone, provided that we are convinced that you have not acted deliberately to allow a third party to access your password. We will hold you responsible for any unauthorized use of your Sobflous Account if we have evidence that you have acted deliberately to allow a third party to access your Sobflous ID and/or your password; that you have acted fraudulently or if, intentionally or through gross negligence, you have failed to fulfill your obligations to use your Sobflous Account as described in this Agreement. Notification to Sobflous of errors, unauthorized transactions and/or improper or unauthorized use of your Payment Instrument (CB or E-dinar).If you believe that there has been or may have been an error, an unauthorized transaction, improper or unauthorized use of your Sobflous Account, you must inform us from the "Contact Us" section.

    Errors:If we discover a processing error, we will rectify the error. If you have received less money than you were due, Sobflous will credit your Sobflous Account with the difference. If you have received more money than you were due, Sobflous may debit the additional funds from your Sobflous Account.


    Information security

    SOBFLOUS is committed to managing your user information according to the strictest standards of information security. We use computer security systems such as firewalls and data encryption, and we control access to our resources and files.

    The security of your SOBFLOUS account also depends on how you protect your SOBFLOUS password. You must not disclose your SOBFLOUS password to anyone. SOBFLOUS representatives will never ask you for your password. Therefore, any email or other correspondence asking for your password should be considered suspicious and unauthorized and forwarded to security@sobflous.tn. If you disclose your SOBFLOUS password to a third party for any reason, including because the third party promises to offer you additional services such as account consolidation, that third party will have access to your account and personal information, and you will be responsible for any operations performed with your password. If you believe that someone may have accessed your password, change it immediately by logging into your account and changing your information settings, then contact us immediately.

    Access to your information and modification: You can review the personal information you have provided to us and modify or change settings related to your SOBFLOUS account at any time by logging into your account on the SOBFLOUS website and clicking on "My account" and modifying your settings.

    Mandatory information:

    1. Not to post, transmit or disseminate any harmful, obscene, defamatory or illegal information on sobflous.tn or from it.
    2. Not to use SOBFLOUS in a way that would infringe upon the rights of others.
    3. Not to make unauthorized, false or fraudulent bookings
    4. Not to use software, "routine" or device to impair or attempt to impair the proper functioning of the site, either manually or electronically, by any means, including downloading or making available files containing altered data or viruses.
    5. Not to degrade, alter or modify the graphic appearance of sobflous.tn or the codes of the software that constitutes it.
    6. Not to take any action that could cause unreasonable or disproportionate traffic on sobflous.tn or on related infrastructure.
    7. Not to obtain or attempt to obtain unauthorized access to any of our networks, by any means whatsoever.

    Without prejudice to all our other rights (whether legal or otherwise), we reserve the right to:

    • Cancel your online purchases or block your SOBFLOUS balance
    • Refuse you access to SOBFLOUS if we believe (in our sole discretion) that you have violated any provision of these Terms of Use.

    Compliance with all laws when using SOBFLOUS services, regardless of their purpose, is entirely your responsibility. Before opening a SOBFLOUS account, you must accept all of the above articles and the terms of the authorized use regulations.
